The most dangerous tickets are those with two points:

  • Flight from peace officer (Vehicle Code 2800.1)
  • Disregard for safety of persons and property (VC 2800.2)
  • Flight, Driving in direction opposite to that which traffic is lawfully moving (Vehicle Code 2800.4)
  • driving while under the influence
  • Speeding or reckless driving (Vehicle Code 23103, 13200) : whenever any person is convicted of a violation of subdivision (b) of Section 22348, the court may, unless this code makes mandatory a revocation by the department, suspend the privilege of the person to operate a motor vehicle for a period not to exceed 30 days.

California's Vehicle Code Section assigns a point system for different types of traffic violations, providing 0 to 3 points for different types of traffic violations. The California Department of Motor Vehicles can suspend or revoke your driver's license if you are classified as a "negligent operator (Vehicle Code section 12810.5a)," if you have accumulated:

  • 4 or more points in 12 months
  • 6 points in 24 months, or
  • 8 points in 36 months.

If you've received a traffic ticket or been involved in a traffic accident from unsafe operation of a motor vehicle, contact the San Jose or Fresno law offices of the Moore Law Firm for a free initial case evaluation. Call 1.866.687.5142.

California's Negligent Operator Treatment System (NOTS) and Driver's License Suspension

Negligent Operator Treatment System counts points and sends drivers a series of computer-generated warning letters when a certain number of points are reached within a certain time frame. An order of suspension is issued when a driver has accumulated 4 points in 12 months, 6 in 24 months or 8 in 36 months.

Very few attorneys in this state know how to effectively handle NOTS cases. They will tell you that if you have 4 points in 12 months, nothing can be done. This is not true, and even if your license is suspended we can help you obtain a restricted license.

Among other traffic offenses we can help you with are

  • Load Inspection (Vehicle code 2802)
  • Control of Illegal size or weight (Vehicle Code 2803)
  • Vehicle and equipment safety inspection (Vehicle Code 2806)
  • California Highway Patrol Scales (Vehicle Code 2809)
  • Commercial Vehicle Inspection (Vehicle Code 2813)
  • Lack of Registration (Vehicle Code 4000)
  • Suspension of Registration (Vehicle Code 4000.38)
  • Display of Plates when one or two license plates are issued. (Vehicle Code 5200)
  • Weight for commercial vehicles and capers. (Vehicle Code 9400, VC 9400.1)
  • Altering or changing vehicle numbers or identification marks (Vehicle Code 10750)
  • Unlawful driving or taking of vehicle without consent of owner (Vehicle Code 10851)
  • Malicious mischief to vehicle (Veh. Code 10853)
  • Unlawful to drive unless licensed (Vehicle Code 12500)

Not the attorneys at the Moore Law Firm.

We request a hearing to dispute the validity of a license suspension resulting from too many points on a driving record. Even if your driving record is correct, and the computation of starting date and point count is beyond reproach, our experienced attorneys know which arguments can call into question a license suspension and how to obtain an exemption or restriction for your particular situation.

In lieu of suspending a person's driving privilege the court may order the privilege to operate a motor vehicle restricted to necessary travel to and from that person's place of employment for not more than six months. If driving a motor vehicle is necessary to perform the duties of the person's employment, the court may restrict the driving privilege to allow driving in that person's scope of employment. VC 13201
