Termination/Modification of Probation

Termination or Modification of Sentence or Probation

Fresno / San Jose Criminal Defense Lawyers

Probation is no simple matter. If you were sentenced to probation for a misdemeanor crime, you are facing a minimum of three (3) years probation, or five years for a felony (or some misdemeanor or repeat) offenses. Regular check-ins, drug testing, counseling, restitution, community service - all of these requirements take time.

Family or work situations can develop over time, making it very difficult for you to complete your probation as ordered. But following the requirements of your probation is extremely important.

If you are having problems with the requirements of your probation, contact a criminal defense lawyer at the Moore Law Firm to ask about early termination of probation or a change in your sentence.

Call 1.866.687.5142.

At the Moore Law Firm, we provide comprehensive criminal defense services to people serving out their probation in Central and Northern California. We understand the challenges you face and the seriousness of the issues. We can explain your options in asking for a modification or early termination of probation and can help you petition the court for a change.

Avoid a Probation Violation

Even if you served your time and paid your fines, if you are on active probation your court case is not closed. Until it is closed there are certain things that can't happen:

  • Immigration paperwork cannot be processed
  • Your paperwork for professional licensure will not be processed (a medical license, nursing license or law license.)
  • Your travel will be restricted. (You may be refused entry to foreign countries, such as Canada.)
  • Any violation of any criminal law may result in a violation of probation.

The court has discretion to terminate your probation early, but it's up to you and your defense attorney. The court does have discretion to terminate probation early - but it's not mandatory or a sure thing. As your defense lawyer, we gather and submit the evidence needed to document why you should be off probation.

Modification of a Sentence

Not only can probation be modified, but a criminal sentence can also be modified by the discretion of the judge. For example, if you have been sentenced to jail time starting on a certain date but there is an overriding family situation that makes it a severe hardship, your Moore Law Firm attorney can petition the court to modify that date.
