Third Offense DUI

San Jose DUI Attorneys

Sentences for Driving Under the Influence of Alcohol and/or Drugs

Typical 3rd DUI Offense within 10 years – Misdemeanor (Vehicle Code 23152)

  • 6 months or more jail (sometimes residential programs will be allowed)
  • 30-month treatment program including community service may be requested
  • five-year formal probation
  • ignition interlock device required
  • 3-year license revocation
  • designation as a habitual traffic offender for three years after conviction
  • 18 months multiple offender dui/drug program
  • over $2,000 in fines and penalties
  • 2 points on your driving record

On a third conviction within 10 years, the fines will increase, as will the jail time. Most counties require 6 months of jail time, and it could be up to one year in jail. Active participation in a drug/alcohol rehabilitation program may successfully reduce your jail exposure. We work with several residential programs and facilities certified and recognized by many judges.
